1 About our terms and conditions
1.1 These terms explain how you may use the JA Resorts & Hotels website or mobile app (the Site). You should read these terms and conditions carefully before using the Site.
1.2 By accessing or using this Site or otherwise indicating your consent, you agree to be bound by these terms and conditions and any other terms or policies referred to in them (the Terms), including our Privacy Policy and Booking Terms.
1.3 The Site is for personal and non-commercial use only. We may prevent or suspend your access to the Site if you do not comply with any part of our Terms or policies on the Site, or any applicable laws.
1.4 We seek to make the Site as accessible as possible. If you have any difficulties using the Site, please contact us at marketing@jaresorts.com.
1.5 Definitions
'Booking Terms' means the terms and conditions which govern any reservations and bookings you make at our hotels and restaurants;
'Content' means the general structure, layout, text, graphics, images, video, audio or other multimedia content, software,
database or other information or material submitted to or on the Site;
'Privacy Policy' means the policy which governs how we process any personal data collected from you and how we use cookies within the Site;
'We, us or our' means JA Resorts
& Hotels LLC, a limited liability company formed under the laws of Dubai, United Arab Emirates with commercial license number 230295 whose office address is PO Box 9255, Dubai, United Arab Emirates. References to us in these terms also includes
our branches and group companies from time to time, including but not limited to Hatta Fort Hotel LLC, Bateaux Dubai LLC and JARH Maldives Pvt Ltd. The hotels and leisure facilities operated and managed by us in Dubai include JA Palm Tree Court, JA
Beach Hotel, JA Lake View Hotel, JA Ocean View Hotel, JA Oasis Beach Tower, JA Hatta Fort Hotel, JA Sports Centre and Shooting Club and Bateaux Dubai. We also own and operate JA Manafaru in the Maldives and operate and manage JA Enchanted Island Resort
in the Seychelles.
'You or your' means the person accessing or using the Site or its Content.
2 Using the Site
2.1 Through this Site, JA Resorts & Hotels provides information about its hotels, restaurants, facilities and other services and activities available at our properties, and an online booking platform which
enables you to make reservations at our hotels and restaurants.
2.2 Your offer to make a booking is not complete until you have provided all the required information and payment details, and submitted your request through the Site.
2.3 When you make a reservation you are entering into a direct (legally binding) contract with us. Your reservation is governed by the Booking Terms.
3 Ownership, use and intellectual property rights
3.1 This Site and all intellectual property rights in it including but not limited to any Content are owned by or licensed to us. Intellectual property rights means rights such as: copyright, trade marks, domain names, design rights,
patents, database rights, software and all other intellectual property rights of any kind, anywhere in the world, whether registered or unregistered.
3.2 We reserve all of our rights in any intellectual property in connection with these Terms and the Site; we remain the owner or licensee, and are free to use them. Trade marks, trade names and other marks used on this Site belong to us or are licensed
to us, and your use of these or of any other marks on the Site is strictly prohibited unless you have prior written permission.
3.3 Nothing in these Terms grants you any legal rights in the Site other than as necessary to enable you to access the Site. Your right is limited to browsing the Content and using the functionality available on the Site. You agree not to adjust, try
to circumvent, or delete any notices contained on the Site (including in connection with any intellectual property), any digital rights or any security or other technology embedded or contained within the Site. You may not copy, reproduce or publish
any Content from the Site without prior written permission.
4 Submitting information to the Site
4.1 Please refer to our Privacy Policy for details of how we collect, use and store your information.
5 Accuracy of information and availability of the Site
5.1 While we use all reasonable care in providing our services, and try to ensure that the Site is as accurate and up-to-date as possible, we cannot be held responsible
for any errors or misleading information.
5.2 Any Content is provided for your general information purposes only and to inform you about our hotels, products and services, news, features and other websites that may be of interest. It does not constitute advice of any kind and should not be relied
on for any purposes. We do not accept liability for any inaccuracies in the description of the hotels or services featured.
5.3 We are unable to promise that the Site will be free from bugs, interruptions or breakdowns, available for your use at all or any time, or that it will be fit or suitable for any purpose. We may suspend or terminate operation of the Site for any reason,
at any time as we see fit, including but not limited to carrying out maintenance and upgrade activity.
6 Hyperlinks and third party sites
6.1 The Site may contain hyperlinks or references to third party websites other than the Site. Any such hyperlinks or references are provided for your convenience only. We have no control over third party websites and accept no
legal responsibility for any content, material or information contained in them. The display of any hyperlink and reference to any third party website does not mean that we endorse that third party's website, products or services. Your use of a third
party site may be governed by the terms and conditions of that third party site.
7 Limitation on our liability
7.1 Subject to clause 7.2, neither we nor our group companies, will be liable for any loss or damage that is not directly arising from a breach by us. We are not responsible for any special, indirect or consequential
losses that happen as a side effect of the main loss or damage (such as loss of opportunity, loss of enjoyment, delay or loss of use). To the extent permitted by law, our liability to you, however arising, shall not exceed the cost of any booking
made through the Site, as set out in the applicable confirmation email.
7.2 Nothing in these Terms shall exclude or limit any liability for fraud or fraudulent misrepresentation, or any other matter which cannot be excluded or limited
by applicable laws.
7.3 None of our group companies, nor any of their directors, officers, employees, representatives or agents, shall have any liability to you. Any rights you may have to bring a claim and any entitlement to remedies arising
out of or in connection with your use of the Site shall be against us alone.
8 Events beyond our control
8.1 We shall have no liability to you for any breach of these Terms caused by any event or circumstance beyond our reasonable control,
including without limitation, services rendered by any third party or business partner; breakdown of systems or network access; strikes, lock-outs or other industrial disputes; flood, fire, explosion or accident.
9 Variation
9.1 We reserve
the right to vary these terms and conditions from time to time. Updated terms will be displayed on the Site and by continuing to use and access the Site following such changes, you agree to be bound by any variation made by us. It is your responsibility
to check these terms and conditions from time to time when using the Site.
10 Disputes
10.1 While we will try to resolve any disputes quickly and efficiently, if you are unhappy with the way we deal with any dispute, the Dubai courts shall
have exclusive jurisdiction to deal with any matters in relation to these Terms. The laws of Dubai, United Arab Emirates will apply.
